. Introduction
Foxpay needs to collect and use certain types of information about natural and legal persons who wish to participate in the Foxpay platform.
Personal information must be collected and processed appropriately in accordance with the Company's AML and KYC policies and this Privacy Policy in accordance with the GDPR.
In accordance with the GDPR, any User providing information under this Policy confirms that he/she understands and accepts the reasons for the collection of information and agrees to the processing of information for the purpose of preventing money laundering.
Any user has the right to know who is responsible for processing his or her personal data.
Any data collected in the course of the Platform's work, whether in paper form, stored in a computerized database or recorded on other materials, is subject to this Policy and is protected by applicable law and the provisions of the GDPR relating to data control and processing.
. Data Protection Officer
Foxpay and its officers and employees are collectively referred to under this Policy and in accordance with the relevant provisions of the GDPR as the Data Protection Officer, which means that it determines the purposes for which personal information is held. It is also responsible for cooperating with national regulators in the correct application of national legislation and the correct use and disclosure of information.
The Data Protection Officer and Foxpay have the following obligations under the GDPR:

Take measures to ensure compliance with the GDPR;
·
Implement the necessary security measures to protect the rights of data subjects when collecting and processing data;
·
carry out data protection impact assessments for high-risk processing activities;
·
implementing privacy protection by default by design;
·
implementation of effective data breach notification.

Foxpay may share data with state regulators and other agencies when required by applicable law or AML policy provisions.
In most cases, platform users will be aware of how and with whom their information will be shared.
Each Platform User shall agree to this Policy and to the use of its data in accordance with the provisions of this Policy and the Anti-Money Laundering Policy relating to data analytics and data disclosure.
In certain circumstances, Foxpay is permitted by law to disclose data (including sensitive data) without the consent of the data subject.
These are:

to perform legal duties or to obtain authorization from any competent legal authority.
·
to protect the vital interests of any party including users of the platform.
·
the information has been disclosed by other third parties.
·
for the purpose of conducting any legal proceedings, obtaining legal advice or defending any legal rights.
·
discloses data to national authorities in accordance with anti-money laundering policies in order to avoid or prevent money laundering.
Any user has the right to request the immediate deletion of personal data relating to him/her by the Data Protection Officer and the Data Protection Officer is obliged to delete personal data immediately if one of the following grounds applies
·
the personal data are no longer necessary for the purposes for which they were collected or otherwise processed
·
the data subject withdraws the consent on the basis of which the processing was carried out (such withdrawal indicates that the user understands that the company will have the right to terminate all cooperation with such user);
·
personal data has been processed unlawfully;
·
personal data must be deleted in order to comply with legal obligations under EU or Member State law to which the Data Protection Officer is subject;
